Conditions of use of the PHAIR ecosystem

These Terms of Service govern access to and use of the PHAIR Global Trust Index ecosystem, including Shartify services, XCircle Token, Blind Shartificator Council and Market Resonance.

Use of the services implies full acceptance of these Terms.

1. Premises and definitions

"PHAIR", "we": QIAO LAB LLC, operating under PHAIR brand
"User", "Institution": Natural or legal person accessing the services
"XCircle Token": Pseudonymous Verifiable Credential enabling ecosystem access
"Shartify Trust Rank": Trust score calculated according to the 3-level protocol
"Blind Council": Anonymous committee of expert evaluators
"ZKP": Zero-Knowledge Proof, cryptographic verification protocol

2. Object of the service

PHAIR provides:

PHAIR Trust Index: digital trust evaluation index for institutions
Shartify Platform: ZKP, Blind Council, Market Resonance infrastructure
XCircle Token: pseudonymous digital passport
Shartificator Awards: recognition for digital trust leaders
Nexth PRIX integration: gateway for phygital award candidacies (requires Rank ≥ 7.0)

3. Registration and XCircle Token

To access operational services it is necessary to:

Complete registration on inxa.one
Provide truthful and up-to-date data
Obtain personal XCircle Token
Custody the Token with required diligence

The user is responsible for all activities performed through their Token.

4. Permitted use

It is forbidden to:

Manipulate or falsify own or others' Trust Rank
Coordinate Market Resonance votes fraudulently
Attempt to identify Blind Council members
Reverse engineer ZKP protocols
Use services for illicit or unauthorized activities
Transfer or share own XCircle Token

Violation results in immediate suspension and possible legal action.

5. PHAIR Trust Index and Shartify Rank

The Shartify Trust Rank is calculated based on:

Level 1: Cryptographic Baseline (ZKP)
Level 2: Blind Shartificator Council
Level 3: Market & User Resonance

The Rank is:

An independent opinion, not a legal certification
Subject to changes over time
Not guaranteed as constant or definitive

⚠️ Important: The Trust Rank does not constitute a credit rating, financial advice or regulated certification. It does not replace evaluations by competent authorities.

6. Blind Council and evaluations

Evaluations are expressed by independent experts in anonymous form
PHAIR does not disclose the identity of evaluators
Council decisions are final and unappealable
Review is not possible except for demonstrable material errors

7. Intellectual property

All rights on:

PHAIR trademark, logos, design system
ZKP protocols, Trust Rank algorithms
Software, interfaces, documentation
Digital badges and report templates

are the exclusive property of PHAIR or its licensors.

The user obtains a limited, non-exclusive, revocable license to use obtained badges according to official guidelines.

8. Limitations of liability

To the maximum extent permitted by law:

Services are provided "as is" without implied warranties
PHAIR is not liable for indirect, consequential damages or loss of profits
Total liability is limited to fees paid by user in preceding 12 months
PHAIR does not guarantee continuity or absence of errors

9. Service modifications

PHAIR reserves the right to:

Modify these Terms with 30 days' notice
Update the Trust Rank protocol
Suspend or discontinue specific services

Continued use after modifications implies acceptance.

10. Applicable law and jurisdiction

These Terms are governed by the laws of the State of Delaware (USA).

For EU consumer users, mandatory protections of country of residence apply.

Exclusive jurisdiction: Court of Chancery of Delaware, unless otherwise mandatorily provided by law.

For cross-border disputes, online ODR mediation procedure (EU platform) is available.
